The Looming Wave of Legal Actions Against Schools in Nigeria: Time to Pay Attention

After three decades of working with numerous schools in Nigeria, from the grassroots to the highest levels, I have come to a profound realization: alarmingly, only a handful of leaders prioritize understanding the legal implications of their decisions before taking action or failing to act. And the last time I checked the law rules all things(yes all things) within the schools system and ignorance of this does not provide anyone a shield but an exposure to the sword of the law.

Moreover, when they do seek legal advice, they often overlook the crucial factor of the legal counsel’s practice area expertise, specifically in matters related to the day-to-day running of a school, education law, and children’s rights. They fall under the misconception that all lawyers are equally equipped to handle any legal issue, neglecting the fact that lawyers’ expertise and reflexes are honed by their dedicated areas of practice, just like medical specialists.

This negligence is a key factor in the escalating trend of legal actions against schools in Nigeria today leading to a concerning number of schools experiencing legal defeats and consequences.

As parents become increasingly aware of their rights, and school leaders continue to neglect seeking legal counsel for their actions and oversights, we must prepare for a surge in legal cases.

It’s crucial that we address this issue proactively to ensure a supportive and responsible educational environment.
